Goulburn Mulwaree Council gives notice of the public exhibition of a Planning Proposal under Schedule 1 of the Environmental Planning and Assessment Act 1979. This Planning Proposal will amend the Goulburn Mulwaree Local Environmental Plan 2009 (GM LEP) by rezoning land at 274 Mountain Ash Road, Goulburn.

Council is currently seeking to rezone 274 Mountain Ash Road, Goulburn within the Mountain Ash Precinct of the Urban and Fringe Housing Strategy, from RU1 Primary Production to R5 Large Lot Residential and part C2 Environmental Conservation, and amend the minimum lot size. The site comprises thirteen existing lots, being Lots 22-24 DP 811954, Lots 1-3 DP 835278, Lot 1 DP 731427, Lot 1 DP 779194, Lot 1 DP 853498, Lot 103 DP 70346, Lot 104-106 DP 126140.
The planning proposal is proponent-led and seeks to rezone the land to R5 Large Lot Residential to provide for seventy two (72) new residential lots. The proposal also seeks to amend the minimum lot size from 100 and 10 hectares to 2 hectares applied to the R5 zoned land with no applicable minimum lot size for the C2 zoned land. The re-zoning to C2 Environmental Conservation Zone is included to encompass flood prone land, up to and including the Probable Maximum Flood (PMF).
The public exhibition also includes an additional draft Site Specific chapter in the Goulburn Mulwaree Development Control Plan 2009 (GM DCP 2009). This chapter will apply to the entire Mountain Ash Precinct and will provide more fine-grain standards which relate to subdivision requirements, biodiversity values, heritage, water quality, contamination, house siting and setbacks, fencing, landscaping and noise attenuation.
Planning Proposal
On 4 April 2023, Council resolved to prepare and forward a planning proposal to the NSW State Government to amend the land use zoning and to amend the minimum lot size. A Gateway Determination (approval to proceed to the next steps in the process) was issued to Council on 10 September 2024 by the NSW Department of Planning, Housing and Infrastructure. This Gateway Determination includes a number of conditions that must be addressed, including government agency and community consultation.
Council has consulted government agencies and is now undertaking community consultation.
The outcomes of this consultation will be reported back to Council for consideration, at which time Council may resolve to proceed, or not proceed with the current Planning Proposal, or proceed with an amended planning proposal. This planning proposal process is expected to be finalised by 10 March 2026.
The Department of Planning, Housing and Infrastructure may determine the planning proposal should there be any outstanding unresolved objections from government agencies.

Submissions may also be made via the NSW planning portal (REF: PP_2021_7072).

Submissions may be provided or published in Council reports and correspondence, on Council’s website, to government agencies, in court proceedings or to any person seeking a copy. The onus is on anyone making a submission to advise if they have made any political donations within the last two (2) years.
