1. Section 138 Application

A Section 138 permit is required to undertake work within Goulburn Mulwaree Council's road reserve. An application fee is payable upon lodgement of your application.

2. Driveway Installation & Inspection Process

If you are applying for Section 138 approval to install a driveway crossover, please refer to Council's Standard Drawings for information on Council's standards and specifications for construction.

When installing a driveway crossover within the Goulburn Mulwaree Council area, work must be constructed according to Goulburn Mulwaree's Council's standards and specifications.

As per the conditions of Section 138 approval, you must:

  • Contact Council to arrange a Pre-Pour Inspection once the crossover has been constructed, but prior to pouring of concrete. You must await approval from the assessing officer prior to proceeding with the pour; and
  • Contact Council at the completion of the works to arrange for a Final Inspection to be undertaken. 

Note: Council requires a minimum of 48 hours notice for an inspection to be booked.

3. Damage Bond Information

Section 138, Development and Complying Development applications may require a damage bond to be paid to Council prior to works commencing. The assessing officer will advise you of this requirement during the assessment process.

Damage bonds may apply to developments such as erection of new buildings, alterations and additions, subdivision of land, swimming pool installation, demolition, and/or other works where the site has frontage to a Council road reserve, or works are being carried out within the road reserve.

The damage bond is held as security until repairs are undertaken to Council infrastructure damaged as a result of activities associated with private construction works.

The relevant damage bond value will be communicated to the applicant as part of the assessment process. Damage bonds are assessed based on categories, as per below:

  • Damage Bond (including Section 138) Minor works including driveway crossover works – fixed amount
  • Damage Bond (including Section 138) Residential development >100k – fixed amount
  • Damage Bond (including Section 138) Non-residential (including work within E2 zone) >100k – fixed amount
  • Damage Bond (including Section 138) Significant works (where deemed necessary by the Business Manager Technical Services) - POA
  • Damage Bond (including Section 138) Other (including street tree bond, etc) - POA

Bond values and administration fees are calculated at the time of lodgement in accordance with Council’s adopted Fees and Charges.

The payment of a damage bond to Council shall be accompanied by a completed Damage Bond Application Form (see below). A damage bond, less the administration fee, is refundable pending satisfactory Final Inspection by an authorised Council officer at the completion of the works.

  • Bradley Street (from Cowper Street to Fitzroy Street) - 5T
  • Bourke Street (from Clinton Street to Citizen Street) - 12.5T
  • Carrick Road - 44T
  • Chatsbury Street (from Union Street to Joshua Street) - 12T
  • Chiswick Street - 5T
  • Common Street - 5T
  • Hetherington Street (from Arthur Street to Memorial Road) - 5T (Buses excepted)
  • Kinghorne Street - 12T
  • Lagoon Street (from Bradley Street to Union Street) - 15T 
  • Lockyer Street (from Sowerby Street to Finlay Road) - 8T
  • Long Street - 5T
  • Memorial Road - 5T Note: Not suitable for vehicles over 10 meters (Buses excepted Rocky Hill side)
